After Toshakhana Conviction, ECP Disqualifies Imran Khan For 5 Years

The Election Commission of Pakistan (ECP) on Tuesday denotified former prime minister and Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan as a member of the country's National Assembly and disqualified him from holding any public office for the next five years.

The notice was issued days after Imran was convicted of corrupt practices and arrested in the criminal case of concealing from the ECP wealth he had acquired after selling the gifts he retained from the Toshakhana.

In a notice issued on Tuesday, the ECP ordered that Imran had been convicted and handed a three-year sentence by the Additional Sessions Judge Islamabad (West) in the case: "District Election Commissioner Islamabad versus Imran Khan Niazi".

"As a consequence, Imran Ahmed Khan Niazi has become disqualified under Article 63(1)(h) of the Constitution of the Islamic Republic of Pakistan, read with Section 232 of the Elections Act, 2017. Therefore, Imran Ahmed Khan Niazi is disqualified for a period of five years and is also denotified as a returned candidate from constituency NA-45 Kurram-l."

Can Imran Khan contest the elections?

Imran Khan will have to wait for five years before he can contest for elections again.

However, he can return to the national assembly in the next elections, provided his legal team can successfully appeal against his conviction and get it overturned by the court.

Once his conviction is overturned, his status under Article 63(1) of the Constitution will also be restored, rendering him eligible to contest elections again.

On Tuesday, Imran's lawyers challenged his conviction and the matter has now been affixed for hearing.
