A district and sessions court of Islamabad has dismissed PTI chief Imran Khan's plea, filed for cancellation of non-bailable arrest warrants issued against him in the Toshakhana case.
Announcing the decision, Additional District and Sessions Judge Zafar Iqbal observed that the warrants could not be cancelled on the basis of an undertaking.
The learned judge issued the verdict while hearing the ECP plea for criminal proceedings against the PTI chief for concealing the details of the foreign gifts meant for the state repository.
Prior to the decision, Judge Iqbal offered to halt attempts by Islamabad police to arrest Imran if he was willing to surrender before the court.
The judge asked the counsel as to why the ex-PM was "resisting" his arrest, saying he was supposed to assist the police instead.
Judge Iqbal, in response to the counsel's arguments, maintained that he wanted the accused inside the court.
Subsequently, the court adjourned the hearing of the case till 12pm tomorrow.
Earlier today, Lahore High Court barred law enforcers from continuing the Zaman Park operation till the verdict of Islamabad High Court regarding the non-bailable arrest warrants of the accused.
During the hearing, the counsel for PTI told the court that Imran is facing security threats. He appeared in four courts in Islamabad but did not appear in the fifth one because there was a 100 percent confirmed information about the murderous attack on Imran Khan in F8 court.
To this, Justice Tariq Saleem Sheikh observed, “In our system, there is a law for acquiring security.”
On the occasion, Advocate General Punjab Shan Gull argued that the matter was still pending at the IHC, so the present petition is not maintainable at the LHC.
On Wednesday, the IHC dismissed a petition filed by the PTI to cancel the arrest warrant.
In its decision, the court asked the counsel representing Imran to pursue the case with the trial court.
During the hearing, Chief Justice IHC Aamer Farooq observed that the court has given relief to the PTI chief earlier as well, terming the current events unfortunate.
